Pata, a popular figure on campus, practiced Tuesday afternoon and was shot Tuesday night at his apartment complex. It was the latest shock to a Hurricanes team touched by tragedy and turmoil, including a separate gun case this season and a wild on-field brawl last month. The 22-year-old senior who grew up in Miami was pronounced dead in the parking lot outside his apartment. His death was ruled a homicide, Miami-Dade police spokesman Roy Rutland said. Pata's mother, Ronette Pata, stood outside his apartment Tuesday night wearing a replica of her son's jersey. "My son had a problem with nobody," a tearful Pata told WTVJ-TV in Miami. "He's gone. He's gone." Word of Pata's death spread quickly around campus, and grief counselors were summoned for his teammates. Another team meeting to discuss a memorial was scheduled for Wednesday, and no decision had been made about the status of Saturday afternoon's game against No. 23 Maryland. "We're trying to get through a hard time right now and it's going to take time," Miami quarterback Kirby Freeman told The Associated Press after a team meeting at the university's athletic complex. "And that's what being a close football family is all about. We're going to help each other with this." School officials said coach Larry Coker was "numb" over the news. The athletic department released a statement urging anyone with information about Pata's death to call police. "Bryan was a fine person and a great competitor. He will be forever missed by his coaches and teammates. We offer our thoughts and prayers to his family," the university said in a statement. Atlantic Coast Conference commissioner John Swofford was working with Miami officials to gather information, conference spokeswoman Amy Yakola said. Rutland said police were called at 7:30 p.m. to the scene and found Pata's body. He lived about 4 miles from campus. No motive was released, and Miami-Dade police did not say who made the 911 call after the shooting. "Right now, we're just gathering ourselves and just trying to pull ourselves together," athletic director Paul Dee told the AP. The 6-foot-4, 280-pound defensive lineman was in his fourth year with the Hurricanes and was expected to be selected in next spring's NFL draft. He appeared in 41 games, making 23 starts. Pata played primarily defensive tackle this season, totaling 13 tackles and two sacks. "Pata was a guidance counselor, in a way, of our football team," Freeman said. "He wasn't the captain of the team, yet people would look to Pata for direction on the way things are going. He was definitely a great leader." Pata was fierce on the field but somewhat soft-spoken off it. "Everyone is just more surprised than anything else," said Annette Ponnock, Miami's student body president. "He's such a personality on campus. It was just really, really shocking to have such a loss. ... He was a big guy so it was kind of hard to miss him. He just had a presence about him." This was at least the fourth time that tragedy involving a player has struck the Hurricanes in recent years. In April 1996, reserve linebacker and Miami native Marlin Barnes was murdered in a campus apartment. And in 2003, former Miami safety Al Blades was killed in a car accident, about a year after former Miami linebacker Chris Campbell -- who had just completed his eligibility with the Hurricanes -- also died in a crash. In July, reserve safety Willie Cooper was shot in the buttocks when confronted in his yard before morning workout. Cooper was not seriously injured. Brandon Meriweather, one of Cooper's teammates and roommates, returned fire at Cooper's assailant, taking three shots that apparently missed, police said. Several Miami players, including Pata, said that was a robbery attempt and cautioned teammates to be aware of their surroundings. "We're targets because we play for the University of Miami. ... These guys, they know who we are," Miami linebacker Jon Beason said shortly after the Cooper shooting. That prompted Coker to say that he did not want his players to have guns, even if they possessed them legally. Last month, Miami brawled on the field with Florida International, a melee where fists, feet and helmets became weapons. Not only are ski resorts pushing legislation in Washington to combat global warming, at least 45 resorts in 14 states from coast-to-coast are using clean energy for some of their operations. Sixteen are getting 100 percent of their power from green energy sources including wind, hydroelectric, solar, bio-mass and geothermal. "I think we're a platform industry. We have a bully pulpit to operate from. When you think of global warming the first thing you think of is snowfall and wintertime and how that changes," said Michael Berry, president of the National Ski Areas Association. Bear Mountain and Snow Summit will spend $6 million on emission controls, said Bob Roberts, executive director of the California Ski Industry Association. Aspen will focus on global warming in three upcoming ads in outdoor magazines. "We did talk internally before doing this. We knew it was risky but we want skiing to be around for 100 years," said Jeanne Mackowski, Aspen's director of marketing. The industry is trying to show individuals that they can make a difference, said Berry. Colorado, which set a record for skier visits last year with 12.53 million skier days, will offer two new gondolas this year. Breckenridge, the nation's second-busiest ski resort, has built a gondola connecting the town's transportation center off Main Street to Peak 7 and Peak 8. The eight-passenger facility, which can carry 3,000 passengers per hour, means fewer people riding buses to the mountain. The resort also has added the highest lift in the nation, the high-speed Imperial Express, which goes to 12,840 feet on the summit of Peak 8. "It has already raised our profile. The thing the gondola does is connect a great historic mining town with one of the great ski areas of the world. You don't get to build too many of them in your career. The Imperial Express on the top and the gondola on the bottom are two great bookends," said Roger McCarthy, Breckenridge CEO. Aspen's Snowmass has installed a new gondola to carry snowriders from Fanny Hill to Elk Camp. In addition, the company is replacing the cabins on the Aspen Mountain Silver Queen Gondola with roomier ones with 360-degree views. Rustic Wolf Creek is adding its first detachable quad -- a four-seat chairlift -- and remote Silverton Mountain will be open all year for unguided skiing. It had been restricted to guided skiing until last spring. Whistler-Blackcomb in British Columbia has installed a high-speed lift to carry riders to the Symphony Amphitheater, 1,000 acres with spectacular high-alpine views. The resort also has purchased Whistler Heli-Skiing, which services over half a million acres of terrain. Utah, which set a record for the third straight year with slightly more than 4 million skier days, has added several high-speed lifts. The Canyons near Park City will grow to 3,700 acres with the addition of 200 acres of mostly intermediate to expert terrain that will be served by the DreamCatcher high-speed quad. The resort also is replacing the four-seat Tombstone Express high-speed with a six-pack that will increase uphill capacity 52 percent and reduce congestion. Snowbird is opening a ski tunnel, the first of its kind in North America. The tunnel's conveyor lift, at the top of the new high-speed Peruvian Express, will transport snowriders from Peruvian Gulch into Mineral Basin. Deer Valley is replacing the Sterling triple-chair on Bald Mountain with a high-speed quad. Fourteen new snowguns will allow Park City to open more terrain in the early season. Powder Mountain is replacing its Hidden Lake double chair with a high-speed quad. Jackson Hole, in Wyoming, retired its legendary tram in October after 40 years. A $25 million tram will be built to replace it, opening in 2008. In the meantime, a temporary two-seater chair will ferry snowriders to the mountain top from one of the existing lifts. In California, Northstar at Tahoe is adding a six-pack. Alpine Meadows has a new 600-foot long superpipe and a terrain park with more than 25 hits, rails, and quarterpipes. Big Sky in Montana added 212 acres of open bowl ski terrain accessed from the Lone Peak Tram in an area called Dakota Territories. In Idaho, Sun Valley's Dollar Mountain will be covered from top to bottom with 44 snow guns. Ski Santa Fe has the first new chair in New Mexico in several years, a triple that opens up six new trails from the top of Deception Peak. Mount Bachelor near Bend, Oregon, is replacing its most-used lift, the Pine Marten, with a high-speed quad. Stowe in Vermont will connect Mount Mansfield and its steep terrain with Spruce Peak's gentler slopes with a Poma lift ride capable of handling 3,400 people per hour. Also in Vermont, a high-speed quad will serve Mount Snow's new terrain park. Belleayre Mountain in New York's Catskills has a new high-speed, too. Early tests of skin-patch vaccines are beginning in hundreds of volunteers, one version designed to protect against the flu and another to prevent travelers' diarrhea. The idea isn't just pain-free vaccination. The National Institutes of Health is helping fund patch research in hopes of strengthening today's imperfect flu shots, and gaining extra help if bird flu or some other super-flu ever triggers a pandemic. Indeed, patch developer Iomai Corp. proposes that the mailman, not a doctor, deliver flu vaccine during a pandemic. Once a vaccine is brewed, simply ship patches to people's homes with instructions to slap one on. Doctors might not like the go-it-alone method. But the technology's main promise may be in developing countries. Unlike syringe-based vaccines, patches wouldn't need refrigeration -- nor pose the infection risk of reused needles, a continuing problem. Only time will tell if the patches really work. Iomai is in initial stages of human testing, and years of additional work are required for proof. But previous research does suggest the skin could provide an improved route to rev up the immune system, perhaps allowing doctors to use lower vaccine doses. "It may be that the expectations for vaccine patch technology are now slowly bearing fruit," says Dr. William Schaffner of Vanderbilt University, a vaccine expert who has long monitored the field. "It is what I would call an alluring technology." Vaccine of the future? If it works against one disease, a patch likely could be tweaked to deliver numerous kinds of vaccines. Iomai also has Defense Department funding to help develop an anthrax vaccine patch. "The approach is novel and may be the way many vaccines are given in the future," says Dr. Herbert DuPont of the University of Texas Health Sciences Center in Houston. A specialist in diarrheal diseases, he is helping Iomai test the travelers' diarrhea patch in U.S. tourists headed for Mexico. Most of today's vaccines are shots into muscle. But doctors have long known that getting vaccine just inside the skin is deep enough. History's first crude inoculations, against smallpox, merely involved scratching pus from a related but milder virus into the skin. And recent research using small needles to push flu vaccine just inside the skin found lower doses could be as protective as full-strength muscle shots. The question is how to do skin vaccination without actually breaking the skin. Patches frequently deliver medications, such as nicotine or birth control. But drugs are very small molecules that can fairly easily penetrate skin to reach the bloodstream. Vaccines typically contain much larger proteins. Iomai's method, discovered by one of its founders at the Walter Reed Army Institute of Research: Just get past a thin outer layer of dead skin to the epidermis, the first living skin layer. There, specialized cells called Langerhans cells can recognize a pathogen and speed to the lymph nodes to alert the immune system. In Iomai's laboratory in Gaithersburg, Maryland, outside Washington, CEO Stanley Erck demonstrates: He brushes his skin with a gadget bearing a bit of sandpaper, like the kind used for filing fingernails. The round patch then is stuck to the scuffed spot for several hours. "We're not inventing anything new, just exposing pathogens the way humans have seen them all their life," Erck says. Waiting for results Now come the tests: • Furthest along are patches designed to protect against an E. coli strain called ETEC, a leading cause of travelers' diarrhea. DuPont's study aims for up to 300 participants to spend at least two weeks in Mexico or Guatemala, visiting pre-specified clinic sites there if they do get diarrhea to see whether the patch failed or the culprit was some other germ. In an initial challenge study at Johns Hopkins University last year, patch recipients who drank the bacteria suffered significantly less diarrhea than their unvaccinated counterparts, Erck said. • Last month, Iomai began first-stage testing of flu vaccine patches in 270 volunteers, to track the patches' safety and whether recipients develop as many flu-fighting antibodies as those given standard flu shots. • Another goal is immune-stimulating patches to boost a vaccine's effects. The elderly are less protected by today's flu shots than young people. And studies of bird-flu vaccine show that a huge dose will be required regardless of age, unless immune-boosters can help stretch supplies. "There definitely is promise to that idea," says Dr. David S. Some may argue whether link bait is good for the Web. The idea is that link bait lowers the quality of content on the Web, pollutes the SERPs and makes it harder to find useful information. However, it may be assumed that 80% of everything is junk and that link bait is another form of low quality content. The benefits of providing truly quality content is that it will help you build a stronger brand and trust, increase conversions and also deliver long-term benefits of reputation, traffic and links. The destruction of such data can lead to serious adverse evidentiary inferences, as illuminated by a very recent case. The case of Easton Sports v. Warrior Lacrosse involves the movement of an employee from one company to another and the allegation that he misappropriated trade secrets and confidential business information from his first employer. A federal magistrate in Michigan recently was called upon in the case to decide whether and to what extent sanctions should be awarded with respect to the failure to preserve certain electronic evidence. The sanction, frankly, could have been much worse. Parties in other recent cases have been ordered to pay millions of dollars in sanctions for failing to retain key electronic data. The magistrate found that the employee had inappropriately accessed numerous confidential electronic documents in his first employer's computer record system. He then transferred at least a portion of those records to his personal Yahoo computer system account. The magistrate further found that the employee corruptly terminated his Yahoo contract with the intent to cause the destruction of information or data compiled through that service. Additionally, the magistrate concluded that he improperly copied confidential business information of his first employer to a CD, that he retained control of the CD after he ceased working for that employer, and that he later accessed the contents of the CD via a computer assigned to him by his second employer. That information was deleted after the filing of the lawsuit by the first employer--but before it was ordered that there be an examination of the relevant computer hard drive, according to the magistrate. While the first employer sought a sanction for this conduct that effectively would have gutted the defenses of the second employer, the magistrate did not go that far, but it did reason that the failure to preserve electronic evidence at least constituted negligence and did warrant an appropriate sanction. The magistrate, in his decision, expressed concern that the second employer was aware of the employee's lack of loyalty to the first employer. Indeed, there was "definite evidence" that the information from the first employer was transmitted to the second employer from the CD and the Yahoo account. The magistrate held that the second employer "should have done more to detect and preserve relevant data" under the control of the employee. The magistrate concluded that the failure to ensure preservation of data "was the result of bad faith." Understanding that the imposition of a sanction should be proportionate to the circumstances, the magistrate did not go so far as to dismiss the defenses of the defendants. However, the magistrate did impose a sanction that likely will have a material affect at trial. Specifically, the magistrate ruled that the spoliation of evidence by the employee, the agent of the second employer, would result in: a) the first employer being able to present evidence at trial about the defendants' failure to preserve electronic data (which likely will result in a serious black eye); an instruction to the jury that it may presume that the destroyed evidence would have been favorable to the first employer; and c) permission for counsel for the first employer to argue to the jury that the evidence that was destroyed likely was negative for the second employer. The second employer was ordered to pay the attorney's fees of the first employer in connection with the sanctions motion. Not surprisingly, there will not be a level playing field at trial. Because of the failure to preserve electronic data, the second employer will be cast in a very poor light--something that it may not be able to overcome to achieve a judgment in its favor. The sanction, frankly, could have been much worse. Parties in other recent cases have been ordered to pay millions of dollars in sanctions for failing to retain key electronic data. Lesson learned. It's better to preserve relevant electronic data, even if it is not the best evidence for your case. As there are various kinds of visitors and there are different things you may want on a website, there should be sufficient ways of finding what the visitor wants with one or two clicks (at most). Apart from having top navigation, you can use secondary navigation. Secondary navigation may be comprised of left or right navigation, a footer and body text. After November 30th, Sullivan will no longer post to the SEW blog. WebProNews asked a group of well-known search industry pros for their thoughts on the day after Sullivan files his last blog entry under the SEW brand. Gary Price chimed back very quickly when I asked him about Danny Sullivan. Price called the highly-regarded search maven "the real deal, a true professional, very intelligent, and a very good person to work for." It's a sentiment we've seen echoed in a multitude of places. A fundamental shift in the search universe took place when Sullivan disclosed he would depart SEW for good at the end of November. He told WebProNews that continuing to write about search, probably through a new blog or site, is something I'm very likely to do," back in August. Sullivan later posted on his personal blog a note that was part of a longer entry about his departure from Incisive Media that he would have news about his new search blog in a few weeks. That would be right around the beginning of December, so we won't know more until then. But what about Search Engine Watch? Anyone who knows anything about marketing understands the importance of brand, especially on the issue of trust. "I see the Search Engine Watch brand and Danny Sullivan's brand being somewhat intertwined, which is not surprising considering he's been at the helm since SEW's inception," Josh Stylman, managing partner at Reprise Media, told us via email. "Within the community of people that "follow" search, I actually think Danny's personal brand is stronger than the site," he said. "For others that are more on the periphery, they might know Search Engine Watch, without necessarily knowing of Danny Sullivan, specifically." I asked Stylman who might be on the short list to slip into Sullivan's place. "Some of the people that have made stellar contributions to SEW, such as Chris Sherman and more recently, Greg Sterling, come to mind," he said. "Others that might be good voices for the site, like Dana Todd, are probably too busy running their own businesses to take over the reins." Todd, the founding partner of SiteLab, certainly would be an intriguing choice. She's been a speaker at every US Search Engine Strategies conference, so she would have the name recognition, the brand, others would recognize. As Stylman observed, Todd is very busy, and she's not on the short list, or any list, to replace Sullivan. She did tell WebProNews that it "wouldn't be ridiculous to consider" ClickZ executive editor Rebecca Lieb possibly pulling SEW under her wing. "I would lean toward someone with significant marketing event experience, as that's really what the show is - running a business," Todd said in considering the conference-organizing side of Sullivan's duties. "You don't necessarily have to be the most knowledgeable person on a subject in order to plan a winning conference, but it helps." "Danny has unique subject matter expertise as well as an ability to plan curriculum that is held in high regard by attendees who come back year after year, conference after conference," Todd said. Stylman agreed with this perspective. "Danny literally built Search Engine Watch from scratch and has done so much for the industry around him," he said. " The biggest potential impact there won't be on the frontlines, but instead as overall master of ceremonies for the site and trade shows, where Danny's responsibilities range from determining the content to finding speakers to about a hundred other things." Perhaps it will take two people to handle Sullivan's roles going forward, and it would not be the first time an iconic person required a couple of people to follow in his footsteps. Maybe someone from within SEW or ClickZ could take the editorial role, while Incisive taps another person to deal with the conference necessities. Moving someone up from within SEW would make sense. "SEW is not a new publication. It is a very well-respected publication, hence it has brand strength," Searching for Profit's Amanda Watlington commented to us about the brand question. "It also has a talented and dedicated staff." We are eager to see what Incisive does when December begins. We're even more fascinated by the prospect of Sullivan's new search site. That marked a gain of six in midterm elections in which the war in Iraq and President Bush were major issues. Earlier, State Sen. Jon Tester triumphed over Republican Sen. With a handful of House races too close to call, Democrats had gained 28 seats, enough to regain the majority after 12 years of Republican rule and place Rep. Nancy Pelosi of California in line to become the first female speaker in history. "It was a thumping," Bush conceded at the White House. "It's clear the Democrat Party had a good night." Allen's campaign issued a statement noting that state officials are conducting a canvass of the votes cast in Tuesday's balloting. "At the conclusion of those efforts, Senator George Allen plans to make a statement regarding the outcome," it said. The Senate had teetered at 50 Democrats, 49 Republicans for most of Wednesday, with Virginia hanging in the balance. But some have charged that government and industry have been guilty of dilly-dallying in their efforts to find out. An article called "Safe Handling of Nanotechnology," to be published Thursday in the journal Nature, seeks to apply pressure to those who are may be dragging their feet in conducting studies--or forking over research funding--that could help assess the not-entirely-theoretical hazards associated with the tiny particles. (Nanotechnology, for the record, is the science of working with materials at the nanoscale. A nanometer is a billionth of a meter, and a human hair measures about 80,000 nanometers wide.) "Without strategic and targeted risk research, people producing and using nanomaterials could develop unanticipated illness arising from their exposure; public confidence in nanotechnologies could be reduced through real or perceived dangers; and fears of litigation may make nanotechnologies less attractive to investors and the insurance industry," wrote the group of 14 international scientists who authored the report. Andrew Maynard, chief science advisor to the the Project on Emerging Nanotechnologies at the Woodrow Wilson International Center for Scholars, led the efforts. The researchers lay out five "grand challenges" for the future: *Devising instruments within the next 3 to 10 years that can measure and detect exposure to engineered nanomaterials in air and water. *Developing and validating tests within the next 5 to 15 years that can determine how toxic engineered nanomaterials are. *Creating models within the next 10 years that can predict the potential impact of engineered nanomaterials on the environment and human health. *Conjuring up, within the next 5 years, "robust systems" for evaluating the health and environmental impact of engineered nanomaterials over their entire life cycle. *And, most urgently, coming up with collaborative, risk-focused research programs that benefit consumers, industry and government during the next year. The blueprint quickly won over some members of Congress, who issued press releases on Wednesday applauding the recommendations and urging their adoption. "The government has an obligation to help fund and conduct that research," U.S. House of Representatives Science Committee Chairman Sherwood Boehlert of New York and Ranking Democrat Bart Gordon of Tennessee said in a joint statement.
