Vonage ordered to pay Verizon $58M

 

ALEXANDRIA, Va. - A federal jury on Thursday found that Internet phone carrier Vonage Holdings Corp. had infringed on Verizon Communications Inc.'s patents and ordered Vonage to pay $58 million.

 

 

The judgment is far less than the $197 million that Verizon had requested, and it was more in line with the figure that Vonage had suggested â۠if the Holmdel, N.J.-based company was found to be liable.

 

Still undetermined is whether Vonage will be barred from using Verizon's technology. Following the verdict, attorneys for New York-based Verizon requested a permanent injunction barring Vonage from further use of the patented technology.

 

A hearing on the request was scheduled for March 23.

 

Verizon sued Vonage last year for infringing on five patents that it said Vonage uses to make its Internet telephone service network functional. The eight-person jury found Vonage infringed on three of the five patents.

 

The jury found in its verdict that Vonage's infringement was not willful. That means that Verizon cannot collect triple damages, which can be awarded in patent infringement cases.

Justice Dept.: FBI misused Patriot Act

 

The FBI improperly and, in some cases, illegally used the USA Patriot Act to secretly obtain personal information about people in the United States, underreporting for three years how often it forced businesses to turn over customer data, a Justice Department audit concluded Friday.

 

 

FBI agents sometimes demanded the data without proper authorization, according to a 126-page audit by Justice Department Inspector General Glenn A. Fine. At other times, the audit found, the FBI improperly obtained telephone records in non-emergency circumstances.

 

The audit blames agent error and shoddy record-keeping for the bulk of the problems and did not find any indication of criminal misconduct.

 

Still, "we believe the improper or illegal uses we found involve serious misuses of national security letter authorities," the audit concludes.

 

At issue are the security letters, a power outlined in the Patriot Act that the Bush administration pushed through Congress after the Sept. 11, 2001, terror attacks. The letters, or administrative subpoenas, are used in suspected terrorism and espionage cases. They allow the FBI to require telephone companies, Internet service providers, banks, credit bureaus and other businesses to produce highly personal records about their customers or subscribers â۠without a judge's approval.

 

FBI Director Robert S. Mueller called Fine's audit "a fair and objective review of the FBI's use of a proven and useful investigative tool."

 

The finding "of deficiencies in our processes is unacceptable," Mueller said in a statement.

 

"We strive to exercise our authorities consistent with the privacy protections and civil liberties that we are sworn to uphold," Mueller said. "Anything less will not be tolerated. While we've already taken some steps to address these shortcomings, I am ordering additional corrective measures to be taken immediately."

 

Fine's annual review is required by Congress, over the objections of the Bush administration.

 

The audit released Friday found that the number of national security letters issued by the FBI skyrocketed in the years after the Patriot Act became law.

 

In 2000, for example, the FBI issued an estimated 8,500 letters. By 2003, however, that number jumped to 39,000. It rose again the next year, to about 56,000 letters in 2004, and dropped to approximately 47,000 in 2005.

 

Over the entire three-year period, the audit found the FBI issued 143,074 national security letters requesting customer data from businesses.

 

The FBI vastly underreported the numbers. In 2005, the FBI told Congress that its agents in 2003 and 2004 had delivered only 9,254 national security letters seeking e-mail, telephone or financial information on 3,501 U.S. citizens and legal residents over the previous two years.

 

Additionally, the audit found, the FBI identified 26 possible violations in its use of the national security letters, including failing to get proper authorization, making improper requests under the law and unauthorized collection of telephone or Internet e-mail records.

 

Of the violations, 22 were caused by FBI errors, while the other four were the result of mistakes made by the firms that received the letters.

Firefighters union assails Giuliani

 

WASHINGTON - One of the nation's largest firefighters' unions has accused Republican presidential contender Rudy Giuliani, the former New York City mayor, of committing "egregious acts" against firefighters who died in the Sept. 11 terrorist attacks.

 

 

In a letter to its members Friday, the International Association of Fire Fighters, excoriated Giuliani for his November 2001 decision to cut back the number of firefighters searching the rubble of Ground Zero for the remains of some 300 fallen comrades.

 

The 280,000-member union accused him of carelessly expediting the cleanup process with a "scoop-and-dump" operation after the recovery of millions of dollars in gold, silver and other assets from the Bank of Nova Scotia that had been buried.

 

Giuliani's campaign insisted that he respects and supports first responders.

 

The former mayor and the union have feuded for years over his policies in the aftermath of the attacks, but the firefighters' latest criticism comes as several polls show Giuliani ahead by wide margins in the GOP nomination race.

 

Seeking to blunt the impact of the accusations, his campaign announced the support of nearly 100 South Carolina firefighters and countered with its own letter from Lee Ielpi, a retired New York firefighter.

 

"There is no one who respects firefighters and first responders more than Rudy Giuliani," Ielpi wrote. "Firefighters have no greater friend and supporter."

 

The union's latest broadside initially was included in a scathing letter dated Feb. 28. Union officials say that letter was drafted as leaders were weighing whether to invite Giuliani to a presidential candidate forum but never was distributed to members because the union ultimately invited Giuliani. Giuliani, however, declined the invitation to next week's forum, citing scheduling conflicts.

 

"We decided to fall on the side of taking the high road and extend an invitation to him," said Harold Schaitberger, the union's general president. "That letter was never intended to be released."

 

Nevertheless, the letter showed up on Web sites this week. After it surfaced, the union decided to send a revised letter with the same criticisms to its members on Friday and posted it on the union's Web site.

 

"Mayor Giuliani's actions meant that firefighters and citizens who perished would either remain buried at Ground Zero forever, with no closure for families, or be removed like so much garbage and deposited at the Fresh Kills landfill," the letter said, adding: "Hundreds remained entombed in Ground Zero when Giuliani gave up on them."

 

"What Giuliani showed is a disgraceful lack of respect for the fallen and those brothers still searching for them," it added.

 

The union said the purpose of the letter was "to make all our members aware of the egregious acts Mayor Giuliani committed against our members, our fallen on 9/11 and our New York City union officers following that horrific day."

 

Ielpi, for his part, said he was "deeply disappointed and disheartened" by the union's recent political activities and called the letter offensive and inaccurate.

 

Tim Brown, a former firefighter and the executive director of Firefighters for Rudy, added: "We are honored by the support of so many first responders from across the country and are appreciative of their continued enthusiasm for Mayor Giuliani's candidacy."

 

The union says it's bipartisan. It endorsed Democratic presidential nominee

John Kerry in 2004.

JetBlue 'hostage' unhappy with CEO

Airline president dismissed talk of compensation, Bay Area blogger says

 

Genevieve McCaw walked into her meeting March 2 with JetBlue Airways' CEO open-minded, hoping for little more than a productive dialogue between embattled airline and embittered passenger.

 

She left an hour later just as frustrated as the day she and her boyfriend spent 101/2hours aboard a plane on a New York airport tarmac with "nothing but chips and soda for sustenance."

 

"You can't know the future, but what I can say right now is that I don't ever, ever, ever want to put another dollar in their pocket," said McCaw, who grew up in Hercules and Pinole. She called from New York City the afternoon of March 2.

 

McCaw, 33, said she was angry and insulted after her marathon Valentine's Day that began and ended at Kennedy airport when severe storms forced JetBlue to cancel more than 1,000 flights affecting 100,000-plus passengers.

 

So she started an Internet blog. It was noticed, by her fellow passengers, the national media and, perhaps most importantly, JetBlue CEO David Neeleman.

 

"I never imagined it would go as far as it did," McCaw said earlier this week. "You kind of roll the dice. Hundreds of people, thousands of people, create blogs every day."

 

McCaw's blog, http://www.jetbluehostage.com, has become a clearinghouse for information about JetBlue, the airline's attempt to make amends and proposals for a passengers' bill of rights, as well as an outlet for frustrations of the travelers McCaw says became hostages aboard Flight 351.

 

She created the site Feb. 16. Hundreds of hits and postings and two CNN interviews later, McCaw earned her face-to-face with Neeleman, presenting him with a list of questions.

 

When it was over, "I felt like he was dismissive, and it was insulting," she said.

 

McCaw said Neeleman began the meeting cordially enough, to the point where she felt bad about asking some of the tough questions her blog readers had hoped for.

 

But as the hour progressed and conversation turned to compensation, "he seemed to get agitated, really short and speaking over me," McCaw said.

 

"I told him I didn't want anything, I wanted to create a dynamic that would create an open line of communication because nothing is going to get solved in an hour meeting," McCaw said.

 

Afterward, she said, she was shuffled into an office, where a JetBlue representative was to provide contact information for people Neeleman told her might be able to answer some of her questions in more detail. The office was empty, and she left after waiting 15 minutes or so.

 

"It was almost like a re-enactment of what happened to us at JFK â۠no one was around to help us. It was really insulting."

 

The airline has since introduced its own Customer Bill of Rights, which had its first test early this week when snow forced the company to cancel 68 flights. People who booked those flights were to receive $100 vouchers and their choice of a refund or a seat on a future flight.

 

"JetBlue is reaching out to customers like Gen on a one-on-one basis to gather their experiences and ask them what we should have done differently," said JetBlue spokesman Sebastian White. He e-mailed the Times before McCaw met with Neeleman.

 

Late March 2 he offered little more from the airline's perspective.

 

"Immediately following the meeting, Mr. Neeleman went to JFK to host an open forum with crew members, so we have not had a chance to talk in detail about the meeting," White said in an e-mail. "He learned quite a bit in the meeting."

 

Outcry over what JetBlue itself has dubbed the Valentine's Day Massacre, coupled with similar frustrations of American Airlines passengers who sat through long tarmac waits during storms in late December, has spurred proposals in Congress for a federal passengers' bill of rights.

 

JetBlue, however, prefers its own approach, believing that it is the best authority on how to serve its passengers. The company's bill of rights "is broader, deeper, and more meaningful to customers than what could be passed in Washington," White said.

 

McCaw, whose mother lives in Pinole, is no stranger to creating an online buzz. Before moving to New York in August, she spent three years with the Walt Disney Co. in Los Angeles, specializing in online word-of-mouth marketing, essentially using blogs and networking communities to get people talking.

 

Her JetBlue blog is titled "JetBlue: A Valentine's Day Hostage Crisis." She writes there: "Nothing says 'I love you' like being held hostage on a frozen plane with the man you love, 99 strangers, 4 other people you happen to know, 4 screaming babies and 3 rambunctious kids running about, nothing but chips and soda for sustenance, faulty power, unreliable direct TV and overfilled sewage system for 11 hours."

 

That her message has stirred emotions and rallied support so effectively is a testament to the power of the Internet, said Steve Rubel, a senior vice president with the me2revolution group at New York-based global PR firm Edelman.

 

"The power has shifted in the last few years to consumers," said Rubel, who helps Edelman identify new media trends. He also runs his own blog, http://www.micropersuasion.com.

 

JetBlue also has used the Internet well, both before and after the crisis, to bolster its image. For example, Neeleman has his own online journal and posted a video apology to customers on YouTube.

 

McCaw, who described herself as "a huge fan of JetBlue" for years, said she plans to continue blogging but will shift the focus to advocating a federal passengers' bill of rights.

 

Before her meeting March 2, McCaw said she would not boycott the airline. Instead, she said, she would shop for the best deals on flights rather than remain "a brand loyalist."

 

Now, she's not so sure.

 

"I've got two round-trip vouchers with them," she said. "I'm going really to make a point to not put any more money in their pocket. I'll use the vouchers, and then I'll likely be done with them."

Conditional Symmetric Instability is a type of instability where air parcels have the capability to travel from low to high altitudes without losing or gaining heat to its surroundings. This is different from buoyant instability, where air parcels can go STRAIGHT up or down. CSI is where parcels can go up and down on a SLANT rather than straight vertically.

 

CSI itself does NOT mean that parcels can go up or down on their own, the parcels initially have to be displaced from their altitude FORCEFULLY - then and only then parcels can travel up and down on a slant. If parcels go up on a slant, it may begin to release latent heat by condensing its water vapor content into cloud droplets or ice crystals.

 

Now, what can force parcels to move vertically on a slant in an area of CSI? Yes, you guessed it - frontogenesis. Frontogenetic forcing can force parcels on the warm side of the airmass collision, and these "warm" parcels can flow upward on a slant TOWARD the cold air, cooling itself in the process. While the parcel cools, it forms clouds and precipitation. The precipitation may now fall through the cold side of the airmass collision as snow. But don't confuse CSI with slantwise convection, because the terminology is different. CSI is just an instability, but parcels are not moving yet. Parcels do not move unless they are forced to. It's only when the parcels are forced and the parcel continues on its displacement path and not going back to where it was initially, then we have slantwise convection.

 

The reason you haven't found a good explanation of this is that CSI is pretty difficult to explain in layman terms. We headed up to Bolton Valley this morning and found about a foot of snow as their report indicated. One of the ski patrollers from the Burlington area said that he actually had more new snow at his house (14 inches on his deck) than they got at the mountain. It continued to snow on the mountain during the day, so they may have accumulated a bit more than the 11 inches they reported at 6:00 A.M. In terms of ski areas, the highest total I've seen so far for this storm is Jay Peak with 20 inches, but that was at 7:00 A.M. and they were still reporting heavy snowfall. I'm sure they've picked up more by now. Many other places are reporting 18 inches, so it looks like a decent dump. It's started snowing here again, and the radar suggests another shot of precipitation may be coming through.

Considering the awful start... and as of the halfway point, none of us could have possibly envisioned a more awful (for snowlovers) winter... this winter was not nearly as bad overall as expected. My snowfall data is at home but I think I will end up at something like 60% of seasonal averages, and it seems like many in the mid-Atlantic are in a similar range. Of course, if this most recent storm had been mostly snow instead of sleet, I'd be at or above average, which tells you how silly the concept of seasonal snowfall averages really are in these parts.

 

Anyway, if I was grading, I'd give the first half and F-minus, literally a 0% as there was not one redeeming feature to the whoe first half of the winter. For the second half of winter, including the most recent event, I'd give a B-. It was plenty cold, often exceptionally so, but it just didn't seem to want to snow. The lighter events were almost exclusively too light with only minimal accumulations and the two heavier events were all ice. Still we had two major winter storm events (V-day and the most recent) that, even though they were almost all ice, were still pretty amazing. You simply don't get an event like those (i.e. widespread heavy moisture coupled with sufficiently cold temps) every season, let alone two of them. Although, if I averaged the half-seasonal grades out, this season would still be a solid F, I am going to give extra credit for both the magnitude and persistence of the turnaround on January 15 and for the fact that we had two storms that, but for an inconvenient warm layer, could easily have been KU-caliber events for large chunks of the I-95 corridor. As a result, I give this season a C- (70%).

 

Congratulations, winter of 2006/07, YOU PASSED!! I didn't think it was possible, but you did it!!

 

I don't mean to put a damper on things, Old Man Winter, but, understand, I cut you a break this year because you came back so strong just when I (and many others) had given up hope of ever seeing snow again. You will NOT be graded so easily next year. A repeat of this year will NOT be given a passing grade again. If you do it again, you will not pass GO and you will not collect $200. Remember that!!
